The petitioner seeks bail in Sessions Trial No.130 of 2016 arising out of Sahar P.S. Case No.123 of 2013 registered under Section 302, 307 and other Sections of I.P.C. and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier twice rejected by this Court. By order dated 21.06.2017, while rejecting the bail of the petitioner, this Court directed the trial court to hold the trial on day to day basis and conclude the same within six months. It is submitted that the trial has not yet concluded and on such, a report
Patna High Court Cr.Misc. No.16297 of 2018 (3) dt.16-05-2018 was called for from the trial court. The trial court sent its report and submitted that the case is pending for the argument of the defence and is likely to be concluded very soon. Taking into consideration that the judgment is likely to be delivered very soon after hearing the argument of the defence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
