2. The petitioner apprehends his arrest in a complaint case registered for the offence punishable under Sections 341, 323 and 354B of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.
3. As per prosecution case, on 15.06.2023 at about 12 o'clock, this petitioner entered into room of the complainant and tried to molest her.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.43561 of 2024(2) dt.25-07-2024 2/3 behalf of the petitioner that due to land dispute between the parties, this false and concocted case has been lodged. It is next submitted that prior to this case, mother of the complainant has also lodged Mithanpura P.S. Case No. 237 of 2023 against this petitioner, in which he is already on bail. It is further submitted that counter-case has also been filed by sister-in-law of this petitioner against the complainant and others bearing Mithanpura P.S. Case No. 239 of 2023.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances and series of cases and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Addl. Sessions Judge-cumSpecial Judge, POCSO Court No.-I, Muzaffarpur, in connection with Complaint Case No. 25 of 2023, subject to condition as
