JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 448, 323, 384 and 354(B) of the Indian Penal Code.
It is alleged by the informant that on 20.09.2014 while the informant was at his door, all the FIR named accused persons arrived there armed with deadly weapon and abused the informant and demanded Rs. two lackhs for Rangdari and threatened to kill him, his brother Sanjay Singh gave to Vijay Singh Rs.20,000/-. Thereafter, the accused persons assaulted him. When the wife of the informant came to rescue, the accused persons assaulted and tried to outrage her modesty by removing her clothes. On Hulla several villagers came and the accused persons fled away.
Patna High Court Cr.Misc. No.26988 of 2015 (3) dt.24-09-2015 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The allegation against the petitioner is superficial in nature. The allegation is made against co-accused Vijay Singh who had demanded Rangdari has already been granted anticipatory bail by the court below which is apparent from the impugned order itself. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Sadar Hajipur P.S.Case No.449 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
