The sole petitioner, who is in custody in G.O. Case no.19/2016 arising out of Bahera P.S. Case No.277 of 2016 registered for the offence under Sections 8,20(b)(ii)(A), 20(b)(ii)(B), 25 of N.D.P.S. Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner has been taken in custody on an allegation of recovery of 300 gms. of Ganja from a Gumti. He submits that recovered Ganja is lesser than the smaller quantity and the petitioner is having clean antecedent, which has been stated in paragraph-3 of the petition.
Learned Addl. Public Prosecutor has opposed the
Patna High Court Cr.Misc. No.46368 of 2016 (3) dt.20-12-2016 2/2 prayer for grant of bail to the petitioner.
However, considering the clean antecedent of the petitioner as well as recovered little quantity of Ganja, let the petitioner, namely, Dev Chandra Jha be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Darbhanga in connection with G.O. Case no.19/2016 arising out of Bahera P.S. Case no.277 of 2016. (Rakesh Kumar, J) NKS/- U T
