The petitioner, Rupesh Singh, apprehends his arrest in Pranpur (Rosna) P.S. Case No.68 of 2014, registered under Sections 365, 498A and other sections of the Indian Penal Code. Najrul Sabzi, the informant, alleged that the petitioner kidnapped his wife.
Learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Code of Criminal Procedure and she alleged that she left the house of her husband and solemnized marriage with the petitioner. The victim is a major woman.
Having considered the fact that the victim herself denied to have been kidnapped, prayer for anticipatory bail is
Patna High Court Cr.Misc. No.52220 of 2014 (2) dt.06-01-2015 2/2 allowed.
The petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Pranpur (Rosna) P.S. Case No.68 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
