JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioners are apprehending their arrest in connection with Raghunathpur P.S. Case No. 25 of 2015 for the offences instituted under Sections 341/323/307/34 of the Indian Penal Code.
Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that all accused persons assaulted the informant's father by lathi and danda. It has been submitted on behalf of the petitioners that the date of occurrence is 13th February 2015 but the case has been instituted on 3rd March 2015 and no explanation has been made on behalf of the prosecution for the delay of 20 days which casts serious doubt on the case of the prosecution. It is further submitted
Patna High Court Cr.Misc. No.26977 of 2015 (2) dt.21-07-2015 2/2 that there is no injury report on the record to suggest that the father of the informant was injured in course of occurrence. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Raghunathpur P.S. Case No. 25 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri D. N. Bhardwaj, Judicial Magistrate 1st class, Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
