2. The petitioner seeks regular bail in connection with Banka P.S. Case No. 80 of 2023 registered for the offence under Sections 341, 323, 307, 302, 120B/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and others are alleged to have killed the deceased. The deceased died during the treatment.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 03.02.2025. He further submits that there is no direct evidence against the petitioner.
5. Learned A.P.P. for the State as well as the learned
Patna High Court CR. MISC. No.43434 of 2025(3) dt.03-09-2025 2/2 counsel for the informant have vehemently opposed the prayer for bail. The learned counsel for the informant has submitted that the deceased before his death had taken the name of the petitioner and other co-accused.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant regular bail to the petitioner.
7. Accordingly, this application for regular bail stands rejected. If the prosecution delays the trial, the petitioner may renew his prayer for bail.
