The petitioner apprehends his arrest in Kotwa P.S. Case No.18 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner has no concern with the hutment from where the alleged recovery has been made. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on

Patna High Court CR. MISC. No.49868 of 2021(2) dt.29-03-2022 2/2 furnishing personal bond to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran in connection with Kotwa P.S. Case No.18 of 2021, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
