JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,342,307,504,506 and 429 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that co accused Harsh Kishore Singh (non petitioner) caused fire arm injury to the buffalo when other buffalos were hit by the petitioners.
It is submitted by learned counsel for the petitioners that specific accusation is only against Harsh Kishore Singh. The accusation against the petitioners is omnibus and general. The petitioners' side lodged Kusheshwar Asthan P.S. Case No. 174 of 2014 at earlier point of time. Statement has been made in
Patna High Court Cr.Misc. No.812 of 2015 (2) dt.09-01-2015 2/2 paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Biraul, Benipur in connection with Kusheshwar Asthan P.S. Case No. 173 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
