JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 302/34 of the Indian Penal Code.

The allegation against the petitioner and other coaccused persons is of killing the brother of the informant. It is submitted on behalf of the petitioner that the petitioner is in custody since 17.01.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses alleged against the petitioner. The informant is not an eye witness to the alleged occurrence. In course of investigation one Raj Kumari Devi, who was accompanied the deceased has claimed herself to be an eye witness to the alleged occurrence. She has

Patna High Court Cr.Misc. No.25392 of 2016 (4) dt.16-08-2016 2/2 stated that one Jitendra Singh fired upon the deceased. No specific allegation has been made against the petitioner. On behalf of the State it has been submnitted that as per aforesaid witness Jitendra Singh is the main assailant. Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Madhubani in connection with Jainagar P.S.Case No. 19 of 2016.
