JUSTICE BIRENDRA KUMAR ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 420 and 406 of the Indian Penal Code. On the persuasion of this petitioner, the complainant had deposited Rs.2,50,000/- in the Amazon Technology Company for getting distributorship. Neither the distributorship was allowed nor the money has been refunded.

Submission is that only Rs.25,000/- has been refunded uptil now.

Considering the fact that main allegation is against the Company of which the petitioner is a Director, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.20591 of 2017 (2) dt.02-05-2017 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua/Successor Court, in connection with Bhabhua P.S. Case No.39 of 2017, with further direction to the petitioner to cooperate in recovery of the money of the complainant from the Company, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
