1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 75, 77 and 329(4) of the BNS, 2023 read with Sections 25(1-B)(a) and 26 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that case diary was called for by an order dated 26.06.2025 passed by a learned Co-ordinate Bench, but the same till date has not been received.

4. The Court will not wait endlessly for the case diary.

5. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that informant alleges

No.39990 of 2025(3) dt.09-09-2025 2/3 that on 24.02.2025 at about 18:30 PM, the petitioner entered his house wielding a gun and started abusing and threatening the family, it is next alleged that informant and his father caught the petitioner and snatched his gun and the petitioner managed to escape.

6. The learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that he was staying with his wife at Madras where petitioner was also working and a relationship started in between the petitioner and his wife, further on coming to know that his wife is in illicit relationship with the petitioner, the informant came back home when the occurrence is alleged to have taken place. It is next submitted that it does not appear probable that had the petitioner entered the house of the informant with gun, the informant and his father could have snatched the same. It is next submitted that no injury has been caused to anyone.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

8. Considering the submissions made by the learned

No.39990 of 2025(3) dt.09-09-2025 3/3 counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nardiganj P.S. Case No. 79 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

9. Accordingly, the instant anticipatory bail application stands allowed.
