JUSTICE BIRENDRA KUMAR ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 420 and 406 of the Indian Penal Code and Section 138 of the N.I. Act.

The dispute arose out of an agreement to sell between the parties. Huge amount of consideration money of Rs.25,00,000/- was allegedly paid in cash.

Allegation is that just to cheat and defraud the sale deed was not executed.

Considering the nature of allegation and the facts aforesaid, let petitioner, above named, be enlarged on bail on

Patna High Court Cr.Misc. No.20595 of 2017 (2) dt.02-05-2017 furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patnacity/Successor Court, in connection with Complaint Case No.734 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
