JUSTICE ARUN KUMAR ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in Maniyari P.S. Case No.200 of 2016 registered under Sections 399, 402, 414 and 120B of the Indian Penal Code, Sections 25(1-B), 25(1-B)a, 26(ii) and 35 of the Arms Act and Sections 20 and 22 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that earlier the petitioner moved for bail before this Court and the same was rejected by order dated 23.02.2017 passed in Cr.Misc.No.5468 of 2017 with an observation that the petitioner may renew his prayer for bail after framing of charge, but out of ignorance it could not be submitted at that time that the charge

Patna High Court Cr.Misc. No.22520 of 2017 (3) dt.17-05-2017 was already framed. However, another co-accused of this case Sujeet Kumar Sharma was granted bail by a coordinate Bench of this Court by order dated 08.04.2017 passed in Cr.Misc.No.11957 of 2017 and the case of the petitioner stands on similar footing. The recovery from this petitioner was one country made pistol and two live cartridges and one mobile phone and he is in custody since 29.10.2016.

The case of the petitioner stands on similar footing to the case of said Sujeet Kumar Sharma, so he is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Spl. Judge, Muzaffarpur in connection with Maniyari P.S. Case No.200 of 2016.
