JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in Kanti P.S. Case No.5 of 2016 registered under Sections 399, 402, 412, 414 of the Indian Penal Code, Sections 25 (1-b)a/26 (ii)/35 Arms Act and Sections 20/22 N.D.P.S. Act.

Allegation in brief is that police, on tip off that some miscreants were assembled in order to commit dacoity, raided the place and arrested many miscreants with arms, narcotic drugs and some injections.

Learned counsel for the petitioner submits that only one loaded country made pistol with three live cartridges were recovered from possession of the petitioner. However, he has been in custody in this case for last one year and one month.

No.43654 of 2016 (4) dt.23-02-2017 2/2 However, it appears from paragraph-3 of the bail petition that this petitioner is accused in number of cases relating to Arms Act, besides other cases lodged under Sections 392, 396 and 302 of the I.P.C. so at this stage, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

It was submitted by the learned counsel for the petitioner that charge in this case has not been framed against the petitioner as yet. The petitioner may renew his prayer for bail after framing of the charge.
