The petitioners apprehend their arrest in connection with Pipra P.S. Case No.108 of 2016 registered under Section 392 of the Indian Penal Code.
The accusation against the petitioners is of snatching Rs.30,000/- from the pocket of the informant while he was going to Patna for the treatment of his daughter and also giving threatening to the informant to withdraw Pipra P.S. Case No.105 of 2016.
Learned counsel appearing on behalf of the petitioners
Patna High Court Cr.Misc. No.36526 of 2016 (2) dt.16-09-2016 2/2 submits that the petitioners and the informant are co-villagers and due to ulterior motive, the petitioners have falsely been implicated in this case. Moreover, the petitioners are not accused in Pipra P.S. Case No.105 of 2016, as such, no question arises for the petitioners to ask the informant to withdraw that case. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Pipra P.S. Case No.108 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
