JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-09-2015 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 415, 420, 406, 407, 409, 120B of the Indian Penal Code and Section 81(ii), b, 81(iii)c, 81 of the Bihar Value Added Tax Act, 2005.
The accusation is of running a transport agency and transporting the goods by mentioning forged TIN numbers and thereby evading tax.
Though earlier also the anticipatory bail application was permitted to be withdrawn since taxes have already been deposited but now the investigating agency is chasing the petitioner.
In view of the fact that earlier the application was sought to be withdrawn on the prayer of the petitioner, this
Patna High Court Cr.Misc. No.35608 of 2015 (3) dt.16-09-2015 2/2 Court is not inclined to modify the earlier application. However, keeping in view of the fact that petitioner has already deposited the alleged taxes, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Mohania P.S. Case No. 379 of 2012, pending in the Court of learned Chief Judicial Magistrate, Bhabhua.
Accordingly the application is disposed of.
