2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.
3. As per prosecution case, allegation against five unknown miscreants is that they snatched the tempo of the informant and fled away.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. He has falsely been implicated in this case on the basis of confessional statement of co-accused Suraj Chaudhary which has got no evidentiary value in the eye of law. It is further submitted that the petitioner is
Patna High Court CR. MISC. No.45675 of 2024(2) dt.02-07-2024 2/2 languishing in judicial custody since 29.4.2024. Similarly situated co-accused Suraj Chaudhary has been enlarged on bail by this Court vide order dated 8.9.2023 passed in Cr. Misc. No. 59573 of 2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bihiya P.S. Case No. 61 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Bhojpur at Ara.
