JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioners are apprehending their arrest in connection with Patory P.S. Case No. 227 of 2014 for the offence instituted under Section 392 of the Indian Penal Code. Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that the informant along with Lala Kumar Mahto had gone to Marufganj and when they were returning from there and reached near village Dasahara, the accused persons came there armed with weapons and took them under their capitation and threatened to shoot and also took away all the belongings, cash, mobile etc. of the victim. It has been submitted on behalf of the petitioners the

Patna High Court Cr.Misc. No.27138 of 2015 (2) dt.21-07-2015 2/2 petitioners are not named in the first information report but their names have come in course of investigation merely on suspicious. It is submitted that the petitioners have got no criminal antecedent. On behalf of the State it has been submitted that the petitioners are named in course of investigation. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Patory P.S. Case No. 227 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
