The petitioner seeks bail in Jogbani (Bathnaha) P.S. Case No. 165 of 2016 registered under Sections 364, 380, 384 and 34 of the Indian Penal Code.

The informant filed a complaint case on the basis of which the present F.I.R. was registered. The informant named the petitioner along with other accused persons and alleged that the accused persons kidnapped his wife and son.

Leanred counsel for the petitioner submits that the victim appeared and made her statement under Section 164 of the Code of Criminal Procedure and she disclosed that Krishna and Shekhar kidnapped her and she made only allegation against the petitioner that the petitioner was threatening her.

Patna High Court Cr.Misc. No.21817 of 2017 (2) dt.11-05-2017 2/2 Considering the facts aforesaid and the fact that the petitioner is not alleged to have kidnapped the victim, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Araria in connection with Jogbani (Bathnaha) P.S. Case No. 165 of 2016.
