The petitioner, namely, Bambam Kumar, (in Cr. Misc. No. 24460 of 2018) is in custody since 21.02.2018 in connection with Gardanibagh P.S. Case No. 44 of 2018 and the petitioner, namely, Bipin Kumar, (in Cr. Misc. No. 24456 of 2018) is in custody since 25.02.2018 in connection with Gardanibagh P.S. Case No. 58 of 2018 registered under Sections 417 and 420 of the Indian Penal Code.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.24460 of 2018(2) dt.14-05-2018 2/2 case of the petitioners is that they had impersonated in the physical test examination conducted by the Central Selection (Police Selection) Office, Patna. It is further submitted that the petitioners have been taken into custody on mere suspicion. It is further submitted that no case under Section 417 of the Indian Penal Code is made out against the petitioners and further that similarly situated co-accused persons have been extended the privilege of regular bail by this Court.
Considering the aforesaid facts and circumstances of the case and that the petitioners have no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Mrs. Sangita Rani, Additional Chief Judicial Magistrate, Patna (in connection with Gardanibagh P.S. Case No. 44 of 2018) and to the satisfaction of Special Judge XV-cum-Additional Chief Judicial Magistrate, Patna (in connection with Gardanibagh P.S. Case No. 58 of 2018).
