====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2), 115(2), 74, 329(4), 110 and 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
3. As per the prosecution case, when the informant was at her house, petitioner came there and tried to molest her and on objection, petitioner assaulted her causing injuries.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, parties are next door neighbourer and due to quarrel between children, marpit took place between the parties. Rest allegations are ornamental. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.39452 of 2025(2) dt.26-06-2025 2/2 for bail.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Nawada in Narhat Police Station Case No. 73 of 2025, subject to the conditions laid down under section 482 Bharatiya Nagarik Suraksha Sanhita, 2023.
