The petitioner seeks regular bail in connection with Rajapakar Police Station Case No. 85 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

The allegation, as per the First Information Report, is that the sister of the informant (now deceased) was married to co-accused Amit Singh about 10 years back and after sometime all the accused persons, including the petitioner, who is cousin father-in-law of the deceased, started demanding a sum of Rs. 2,50,000/- from the deceased for the purpose of starting of

It has further been alleged that the informant after selling his land handed over a sum of Rs. 1,00,000/- to co-accused Amit Singh. It has further been alleged that all the accused persons killed the deceased by strangulating her neck for non-fulfillment of the demand of dowry.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case without any basis inasmuch as from perusal of the First Information Report itself, it would be evident that the petitioner is not the direct relative of the husband of the deceased inasmuch as he is the uncle of the husband of the deceased and is separated in mess and residence from the family of the deceased for the last many years and is having no concern with the family affairs of the husband of the deceased. He further submits that the allegation against the petitioner is general and omnibus in nature and he is in custody since 05.07.2020 and the husband of the deceased is already in custody.

Having heard learned Counsel for the parties and taking into consideration the materials on record, the nature of allegation and the fact that the petitioner is in custody since 05.07.2020 and charge sheet has been submitted against the

Patna High Court CR. MISC. No.4051 of 2021(3) dt.08-04-2021 3/3 petitioner, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Rajapakar Police Station Case No. 85 of 2020.
