Petitioner apprehends his arrest in a case registered for the offence punishable under Section 467, 468, 420, 323 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, this petitioner received Rs. 1, 65,000/- cash and Rs. 5,00,000/- has been transferred in his account and the petitioner agreed to sale his land to the informant within ten days but later on he sold the land to another person and, thus, cheated and duped the informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that informant has not annexed any paper to show that there was any agreement for sale and this

No.40699 of 2022(8) dt.12-05-2023 2/2 false case has been filed in order to grab the rest amount of Rs. 1,60,000/- which the informant has taken as loan from the petitioner. By filing supplementary affidavit it is submitted that petitioner has brought demand draft of Rs. 3,35,000/- of Central Bank of India No. 136698 dated 27.03.2023 in favour of the informant and the same is being received by Mr. Ajay Kumar Pandey, learned counsel for the O.P. No.2. Petitioner has got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Siwan in connection with Pachrukhi PS case No. 237/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
