JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner apprehends his arrest in relation to Complaint Case No. 26940(C) of 2014 registered under Sections 498A, 323 and 420 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

The petitioner is the husband of the complainant. They were married in the year 2006 and this complaint is being filed in the year 2014 for offences under Section 498A and other Sections of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

Learned counsel for the petitioner draws attention of this Court to the statement made in paragraph 8 of the complaint

Patna High Court Cr.Misc. No.18361 of 2015 (2) dt.11-06-2015 2/2 petition and other parts of the complaint to show that in fact the actual complaint of the complainant is with regard to certain properties of the family and it is because of that this complaint has been filed.

Be that as it may, in the event of his arrest/surrender before the court below within four weeks from today, let the petitioner, namely, Dheeraj Kumar Gupta be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna in connection with Complaint Case No. 26940C of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
