The petitioner seeks bail in Mufassil P.S. Case No. 118 of 2017 registered for the offences punishable under Section 376D and other Sections of the Indian Penal Code and under Sections 66(A)(B)(C) of the Information and Technology Act. The victim alleged that Nand Kishore Sahani, Dayanand Sahani, Dipak Sahani, Krishna Sahani and Gaukaran Sahani caught her and committed rape with her one by one and they also took out photographs and shared on mobile with others. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The victim alleged that Nand Kishore Sahnai and his four sons committed rape with her one by one, but the story disclosed by the victim does not appear to be

Name of the petitioner figured in the case during course of investigation, as the petitioner is said to have taken snaps of the occurrence. Considering the facts aforesaid and the fact that the petitioner is not the person who is alleged to have committed rape with the victim and he is in jail since 24.03.2017, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Mufassil P.S. Case No. 118 of 2017.
