JUSTICE RAKESH KUMAR ORAL ORDER 22-10-2016 Heard Sri Ramesh Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 27.07.2016 in Sikty P.S. Case No.120 of 2016 registered for the offence under Sections 272/273 of the Indian Penal Code and Section 47 of the Bihar Excise Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation of recovery of huge quantity of Nepali Wine, the petitioner has been made accused and arrested. He submits that at the time, when the petitioner along with one another accused was arrested, one person was shown fleeing away. By way of referring to the statement made in paragraph-3 of the petition, it was submitted that the petitioner is having clean antecedent.

No.46291 of 2016 (2) dt.22-10-2016 2/2 Keeping in view the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner, namely, Munna Kumar Yadav be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrat-3, Araria in connection with Sikty P.S. Case No.120 of 2016.
