====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hasanpur P.S. Case No. 239 of 2016 instituted for the offence under Sections-379/411 of the Indian Penal Code.

It is alleged that the petitioner withdrew Rs. 48,000/- from the bank for purchasing in the market. In the meantime, one boy took away the bag from the dicky of his motorcycle containing the money. He was chased and caught and disclosed the name i.e. the petitioner. The petitioner is said to be in custody since 20-10-2016.

From the written report itself, it appears that the petitioner was caught on the spot but there is no recovery from his possession. In paragraph-3, it has been mentioned that the

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hasanpur P.S. Case No. 239 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-III, Rosera subject to condition that both the bailors should be close relatives of the petitioner.
