JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Nathnagar P.S. Case No. 742 of 2017, dated 09.12.2017, instituted for the offences punishable under Sections 302/34 of the Indian Penal Code. One of the brothers of the informant was murdered by means of hard and blunt substance.

Information about the aforesaid murder was given by a covillager to the informant. Hence, the subject F.I.R. was lodged by the informant, alleging that since the deceased always talked with one Tete Yadav of the village and the petitioner was a close associate of aforesaid Tete Yadav,

Mr. Syed Masleh-Uddin Ashraf, learned Advocate for the petitioner has submitted that but for this wild suspicion and that also by a brother of the deceased who does not stay in the village home, the petitioner has been made accused in this case.

The petitioner does not have any criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Bhagalpur in connection with Nathnagar P.S. Case No. 742 of 2017.
