Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 17-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. Allegation is of demand of dowry and torture for nonfulfillment of demand of dowry. The petitioner is in custody since 15.11.2019.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Majhaulia P.S. Case No.490 of 2019. Hence, prayer for bail is refused. If the trial is not concluded within nine months from
Patna High Court CR. MISC. No.3976 of 2021(6) dt.17-08-2021 2/2 the date of receipt of a copy of this order the petitioner would be at liberty to renew the prayer for bail before the Court-below itself.
