The petitioners seek bail in Bhaptiyahi P.S. Case No. 16/2017, registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. On information the informant raided a place where four persons including the petitioners were digging sand, petitioners and others were apprehended. From possession of the petitioners 156 bottles of Nepali liquor each containing 300 ml and 60 bottles each containing 180 ml of foreign liquor was recovered. It is submitted that the petitioners were cutting grass for their animals and they have no manner of concern with the recovered liquor. The petitioners are in jail since 10.02.2017.

No.21857 of 2017 (2) dt.16-05-2017 Considering the facts aforesaid and the fact that the petitioners are in jail for more than 03 months, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge II-cum-Spl. Judge (Excise), Supaul in connection with Bhaptiyahi P.S. Case No. 16/2017.
