JUSTICE SUDHIR SINGH ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 379 and 411 of the I.P.C. Allegation is that one looted motorcycle was recovered by the police from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.7.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be the pillion rider on the motorcycle. He had no knowledge that the motorcycle in question was stolen property. It is further submitted that the petitioner may be released after completion of
Patna High Court Cr.Misc. No.46391 of 2016 (5) dt.23-12-2016 2/2 six months in custody from 13.7.2016.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of nine months in custody from 13.7.2016 on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Ghosi P.S. case No.212 of 2016.
