The petitioner seeks regular bail in connection with Madhubani Town P.S. Case No. 375 of 2017, registered for the offences punishable under Sections 384, 504 and 506/34 of the Indian Penal Code.

The allegation is regarding demand of extortion money by means of mobile phone through two mobile numbers and the petitioner is stated to have called from one of the said mobile numbers.

The learned counsel for the petitioner submits that the petitioner is not a habitual offender and he has been falsely implicated in the present case as well as the fact is that the call

Patna High Court Cr.Misc. No.24964 of 2018(4) dt.05-07-2018 2/2 was made by another co-accused, namely, Banti. It is further submitted that though the petitioner has been shown to be accused in nine cases of the year 2012, but all the said cases arise out of the same occurrence and the petitioner has been granted bail in the said cases. Lastly, it is submitted that the petitioner is languishing in custody since 08.12.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S.
