2. The petitioner apprehends his arrest in connection with Raghopur (Rustampur O.P) P.S Case No. 72 of 2024 registered for the offences punishable under Sections 272, 273, 414 of Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, total 200 litre illicit liquor has been recovered from the tempo.

4. Learned counsel for the petitioner submits that petitioner has been falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner name of the petitioner surfaced from the statement of

Patna High Court CR. MISC. No.43376 of 2024(3) dt.29-11-2024 2/2 the co-accused. It also submitted that the seized tempo does not belongs to petitioner it belongs to co-accused. It is next submitted that petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

5. Learned counsel for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court No. 2 cum Additional Sessions Judge, Vaishali at Hajipur in connection with Raghopur (Rustampur O.P) P.S Case No. 72 of 2024 subject to the condition laid down under Section 438(2) of Cr.P.C.
