The petitioner apprehends his arrest in connection with Madhubani (Town) P.S. Case No. 139 of 2013 registered for the offence under Sections-408 & 420 of the Indian Penal Code. Admittedly, the petitioner was appointed agent of the informant in his wine shop and the accusation against the petitioner is that he misappropriated near about Rs four lacs but the contention on behalf of the petitioner is that there was dispute of wage and when the petitioner demanded his wage from the informant, the informant lodged this false case. Case No. 139 of 2013 to the satisfaction of Chief Judicial Magistrate, Madhubani subject to conditions as laid down u/S 438(2) of the Cr. P.C.
