This application for anticipatory bail arises out of Rajauli P.S. Case No. 183 of 2017, disclosing offences under Sections 147, 148, 341, 323, 324, 307, 325, 379, 427, 504 and 506 of the Indian Penal Code.

It is alleged in the FIR that the informant and his nephew were moving in a motor-cycle, when they were intercepted by the accused persons, who, at the first instance, hurled abuses and thereafter assaulted them variously. Allegedly, Malu Yadav (petitioner no.2) snatched the informant's watch. However, considering the fact that the petitioners

Patna High Court CR. MISC. No.39327 of 2019(2) dt.27-06-2019 2/2 have criminal antecedents, I am not inclined to grant them the privilege of anticipatory bail. This application is accordingly rejected.

The petitioners are directed to surrender in the court below within four weeks from today and seek regular bail, if so advised. If they do so, the court below shall consider their prayer for regular bail on its own merit, without being prejudiced by the rejection of the present anticipatory bail application.
