The petitioners Sunerpati Devi and Sugriv Ram apprehend their arrest in Bagaha (Bhairoganj) P.S. Case No. 244 of 2014, registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code. Bahadur Gond made allegation that Sunerpati Devi and Kedar Ram were plucking mango from his tree for which he chided her. On the next day Kedar Ram, Bachcha Ram, Feku Ram and Sugriv Ram came there. Kedar Ram assaulted the informant with Pharsa and others assaulted him with Lathi. It appears that there is no allegation of assault against Sunerpati Devi. The informant Bahadur Gond received one injury on left side of head parietal region which is attributed to Kedar

Patna High Court Cr.Misc. No.397 of 2015 (2) dt.07-01-2015 Ram. Other injuries are complain of pain.

Considering the facts aforesaid and the fact that there is no specific allegation of assault against the petitioners, they, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Bhairoganj) P.S. Case No. 244 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
