The petitioner seeks regular bail in connection with Alinagar P.S. Case No. 95 of 2017, registered for the offence punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioner herein having kidnapped the victim girl. The learned counsel for the petitioner has submitted by referring to the statement of the victim girl made under Section 164 Cr.P.C. that it appears that the victim girl was willingly staying with the petitioner herein. In fact, it is also apparent that there is no allegation of any rape having been committed by the petitioner herein.
The petitioner
Patna High Court Cr.Misc. No.24279 of 2018(5) dt.04-07-2018 2/2 is stated to be languishing in custody since 18.01.2018. Per contra, the learned counsel for the informant has submitted that charge-sheet has already been filed in the present case.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Benipur, Darbhanga in connection with Alinagar P.S. Case No. 95 of 2017.
