JUSTICE ARUN KUMAR ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner has misused the privilege of bail earlier granted to him. The period of misuse is three years approximately. The petitioner is accused in Alamganj P.S. Case No.4 of 2012 registered for the offences under Sections 353 and 307/34 of the Indian Penal Code and Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.

Learned counsel for the petitioner submits that earlier the petitioner's prayer for bail was rejected by this Court vide order dated 29.03.2017 passed in Cr.Misc.No.15336 of 2017 with an observation that the petitioner may renew his prayer for bail after framing of charge or after three months whichever is

Patna High Court Cr.Misc. No.22690 of 2017 (4) dt.17-05-2017 earlier. Now, the charge has been framed against the petitioner by order dated 18.04.2017 and he is in custody since 17.02.2017. Considering the said facts and circumstances, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Patna City, district-Patna in connection with Sessions Trial No.838 of 2012, arising out of Alamganj P.S. Case No.4 of 2012, with condition that one of the bailors shall be family member of the petitioner and in case of default on two consecutive dates the bail bond of the petitioner shall be liable to be cancelled.
