The petitioner seeks bail in Bihta P.S. Case No. 913/2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.
One country made pistol, six live cartridges and three misfire cartridges are said to have been recovered from the possession of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case at the instance of his enemy by planting aforesaid recovery from his possession. No incriminating article has been recovered from his conscious physical possession. Prior to the present case, the
Patna High Court Cr.Misc. No.24765 of 2018 (3) dt.24-05-2018 petitioner has been made accused in two other cases in which he is on bail. The petitioner has been languishing in custody since 08.11.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur in connection with Bihta P.S. Case No. 913/2017.
