====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2017 No one appears on behalf of the appellant on repeated call. The office has reported that appellant failed to remove defect in I.A. No. 211 of 2015, as pointed out by the office and vide peremptory order dated 16.02.2016, I.A. No. 211 of 2015 stood dismissed and therefore, the office has made a query as to whether whole memo of appeal becomes infructuous or not.

Since this miscellaneous appeal is said to be time barred and there is no petition for condoning the delay, this appeal stands dismissed being time barred.
