JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302 of the Indian Penal Code and Section 27 of Arms Act.

The informant Husntara Khatoon has alleged in her written petition that in the night of 18.9.2013 at about 12.30 unknown accused committed the murder of her husband Momtaz Mian by gun shot injury.

It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR. It is further submitted that there is no eye witness to the occurrence and the matter has been compromised between the parties.

On behalf of the State,it has been submitted that

Patna High Court Cr.Misc. No.28772 of 2015 (2) dt.27-07-2015 2/2 the name of the petitioner has come in course of investigation. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,West Champaran at Bettiah in connection with Chanpatia P.S.Case No. 293/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
