Mr.Bhanu Pratap Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 29-11-2022 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence under Sections 302 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. The case relates to dowry death of the sister of the informant. The petitioner is alleged to have been in illegal affairs with the husband of the informant and both of them have conspired the death of the deceased.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has falsely been implicated in this case. He further submits that the petitioner happens to be sister in

Patna High Court CR. MISC. No.40888 of 2022(3) dt.29-11-2022 2/2 law of the deceased and there is no specific allegation of any assault or any overt act committed by her is attributed to her. He further submits that the petitioner has no concern with the alleged occurrence. He further submits that there is no eye witness to the alleged occurrence. Hence, the petitioner may be granted the privilege of anticipatory bail. Learned A.P.P. for the State as well as learned counsel for the informant on the basis of material available on record and the case diary submits that during investigation, it has surfaced that the petitioner was having illicit relation with the husband of the deceased and on that count the sister of the informant is made a victim of conspiracy hatched by the petitioner.

Considering the facts and circumstances of the case and gravity of offence, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, this application is dismissed.
