JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim girl has recorded her age as 15 years and the court has assessed her age as such where she stated that she went in the company of co accused Manu to Delhi and from there the co accused Manu and the petitioners being brother and uncle of Monu took the victim to Raipur and got her married.

It is submitted by the learned counsel for the petitioners that 164 Cr.P.C statement reflects that the victim was not kidnapped and she went in the company of Manu of her own.

Patna High Court Cr.Misc. No.27741 of 2015 (2) dt.23-07-2015 Considering the tutored 164 Cr.P.C. statement of the victim that she went in the company of Manu of her own, for the occurrence of 20.1.2015 the FIR being lodged on 23.1.2015 and Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Nawanagar P.S. Case No. 16 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
