The petitioner seeks bail in connection with Mansoorchak P.S. Case No. 07 of 2016 registered for the offences punishable under Sections 115, 120B/34 of the Indian Penal Code.
As per the first information report, the petitioner recorded in his mobile the entire conspiracy whereby the informant was to be killed and the informant has given the name of the persons who have conspired to kill but in that the petitioner is not named. It has been submitted that other accused persons are enjoying the privilege of pre-arrest bail vide Cr. Misc. No. 18176 of 2016 and the petitioner was arrested and is suffering in custody. No.41933 of 2016 (2) dt.17-10-2016 above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Begusarai in connection with Mansoorchak P.S. Case No. 07 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
