JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 3⁄4 of Explosive Substance Act and various sections of U.A.P.A. Act.

Five pieces of jute bags and one naxalite pamphlet are said to have been recovered from possession of petitioner no. 2 whereas five litres petrol kept in a gallon was recovered from possession of petitioner no. 1. So far as recovery of detonators and other explosive substances are concerned, the same were recovered from possession of other accused. Petitioners were made accused in one case i.e. Dariyapur P.S. Case No. 200 of

Patna High Court Cr.Misc. No.39202 of 2016 (2) dt.26-09-2016 2/2 2013 prior to institution of the present case. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners are languishing in jail custody since 05.04.2016, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Muzaffarpur in connection with Kurhani P.S. Case No. 104 of 2016.
