Petitioner is in custody in connection with Barachatti (Mohanpur) P.S.Case No.798 of 2018 registered for an offence under Sections 302, 201 and 120B of the Indian Penal Code. As per prosecution case the petitioner came to the informant's house and took away his son with him who did not return thereafter. Informant's suspected the hand of the petitioner in the murder of his son.
It is submitted on behalf of the petitioner that there is no eye witness to the occurrence and petitioner has been roped in the case only because of being a friend of the victim. He further submits that similarly situated co-accused Vikram Kumar @ Vikram has already been granted regular bail by a
Patna High Court CR. MISC. No.36698 of 2019(3) dt.04-09-2019 2/2 coordinate Bench of this Court in Cr.Misc.No.44565 of 2019. It is also submitted that petitioner has got no criminal antecedent and he is in custody since 01.01.2019.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S.Case No.798 of 2018.
