Earlier, the prayer for bail of the petitioner was rejected by this Court taking note of statement of the victim recorded under section 164 of the Cr.P.C but in course of trial, the victim retracted back from her statement and refused to identify the petitioner at the time of recording of her deposition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st cum Special Judge, Saharsa in connection with POCSO Case No. 01 of 2016 arising out o f Nauhatta P.S.Case No. 250 of 2015.
