1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363, 366, 379, 504, 506, 34 of the Indian Penal Code.

3. Learned counsel for the petitioners, after some arguments, seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 1 Mirtunjay Kumar.

4. Permission is accorded.

5. It is next submitted that Petitioner No. 2 has antecedent of one case and is a woman and the informant alleges that his wife on 11.07.2020 at 09:00 AM left her house

Patna High Court CR. MISC. No.40645 of 2026(2) dt.06-07-2026 2/3 on the pretext of getting her driving license made, but did not return, hence during search it transpired that Rs. 44 lakhs along with jewellery cost Rs. 8 lakhs was missing, next alleges that he came to know that his wife was seen accompanying Raja @ Sunny towards Samastipur, accordingly, he went to the house of Raja to inquire when his parents and wife abused and ousted him.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the FIR and her name transpired during the course of investigation, it is next submitted petitioner is wife of Mirtunjay and during the course of investigation, it transpired that Mirtunjay was in constant touch with the victim on the date of occurrence as recorded at Para 28 of this case diary. It is thus submitted that petitioner being wife of Mirtunjay also came to be implicated in the instant case.

7. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.

8. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the fact that petitioner is a woman, the petitioner no. 2 above-named, in the event of her arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.40645 of 2026(2) dt.06-07-2026 3/3 from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Patory P.S. Case No. 249 of 2020 subject to the conditions as laid down under Section 482 (2) of the BNSS.

9. The application stands allowed.
