JUSTICE VIKASH JAIN ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State as well as learned counsel for the complainant.

The petitioner apprehends his arrest for the alleged offences under sections 385, 467, 468, 420, 471 of the Indian Penal Code registered in connection with Complaint Case No. CA 210 of 2014.

It is submitted that the petitioner has been falsely implicated in the backdrop of past enmity with the complainant and even in the past it was alleged by the complainant that the petitioner was taking illegal gratification in the matter of appointments. It is submitted that making of such appointments

Patna High Court Cr.Misc. No.27541 of 2015 (3) dt.29-04-2016 are within the domain of the District Teachers Appellate Authority, Katihar and was not in the hands of the petitioner. In that view of the matter, the provisional bail granted to the petitioner by order dated 24.07.2015 pending in the court of Sri S. Kumar, Judicial Magistrate, 1st Class, Katihar in connection with Complaint Case CA No. 210 of 2014 is hereby confirmed.
